What Do Insolvency and Bankruptcy mean?

While people sometimes make the mistake of assuming they mean the same thing, they are actually specific terms for individuals and companies. 

 

Insolvency

Insolvency is when a company's liabilities are greater than its assets and/or it cannot pay its bills when they become due.

Bankruptcy

In the UK, bankruptcy is a formal legal process for individuals who cannot pay their debts. It does not apply to limited companies or partnerships. 

So if you are an individual or a sole trader, you will probably want to look for information on Bankruptcy. If you are looking on behalf of your business, for example, you are a director, then insolvency is the right legal term.
